Tour terms and conditions
OUR TERMS AND CONDITIONS:
Kinetic Tours Memories S.A.S ("K.T.M."), operating under the commercial names Kinetic Tours Memories and ADV Riders Colombia, is a legally registered entity in Colombia, with NIT No. 900.723.669-4. K.T.M. is duly licensed by the Ministry of Industry and Tourism under RNT No. 3769, in compliance with Colombian law. For the purposes of these Terms and Conditions, "K.T.M." refers to Kinetic Tours Memories S.A.S., including all its operations and services provided under any of its trade names.
By submitting the online tour registration form and paying the booking deposit, you ("Participant") acknowledge that you have read, understood, and agree to be legally bound by all Terms and Conditions set forth in this agreement. This constitutes a binding contract between Kinetic Tours Memories S.A.S. ("K.T.M.") and the Participant.
Furthermore, participation in any K.T.M. tour requires the submission of a duly signed Rental Motorcycle Handover Agreement and a completed medical questionnaire. If you are utilizing a K.T.M. rental motorcycle, you will also be subject to the RENTAL TERMS AND CONDITIONS. In certain tour destinations, rental motorcycles may be provided by third-party partners, in which case, the rental terms and conditions of these partners may apply. Full rental details, including applicable terms and conditions, will be provided based on the specific tour destination selected..
1. PURPOSE OF THE CONTRACT
To govern the agreement between K.T.M. and the tour services offered to the Participant.
2. RESERVATION, DEPOSIT, AND BALANCE
Registration Form: Submission of an online registration form does not guarantee availability or confirm a reservation. Availability is confirmed only upon receipt and acceptance of the required deposit.
Deposit: To establish and secure a reservation, a nonrefundable booking deposit of USD 999 is required. This deposit will be applied to the total tour balance.
Balance: The remaining tour balance must be paid in full no later than 60 days before the scheduled start of the Tour unless otherwise specified in the tour description on our website. The balance payment is also non-refundable. K.T.M. reserves the right to cancel any tour if the balance is not paid by the due date without obligation to refund the deposit.
Protection of Deposit and Balance: To protect your deposit, balance, and overall travel investment, K.T.M. strongly recommends that you purchase trip cancellation and travel insurance through Global Rescue, your credit card provider, or a reputable third party. This insurance can help safeguard your payments and travel plans against unforeseen circumstances.
3. THE TOUR PACKAGE
The services listed below are generally included in the tour package; however, minor variations may occur. For a detailed and specific list of inclusions and exclusions for each tour, please refer to the corresponding tour page on our website.

Rental Terms and Room Accommodations
The Participant agrees to abide by the K.T.M. RENTAL TERMS AND CONDITIONS when utilizing one of our rental motorcycles on guided or self-guided tours in Colombia.
In certain destinations, rental motorcycles may be provided by third-party partners, and different rental terms and conditions may apply. K.T.M. will fully disclose any third-party rental terms and conditions based on the chosen tour destination.
Motorcycle availability and upgrade fees vary depending on the tour destination. Participants are advised to review the specific details and rates on the tour page at www.AdvRidersColombia.com.
For Participants traveling solo who request a shared room, K.T.M. will make reasonable efforts to find a suitable roommate. If a suitable roommate cannot be found, the Participant will be required to pay for a single-room upgrade.
5. PERSONAL PAPERWORK, TRAVEL PERMITS, AND VISAS
The Participant is solely responsible for ensuring compliance with all passport and visa regulations for each destination included in the tour. K.T.M. will make reasonable efforts to provide general advice but cannot guarantee the accuracy or completeness of visa requirements, regulations, or restrictions, which are subject to change. It is the Participant’s responsibility to conduct thorough research and obtain necessary visas and travel permits. For initial research, Participants may consult resources such as www.visaHQ.com.
6. SUPPORT VEHICLE AND PASSENGER
For tours with five or more confirmed riders, a support vehicle will be provided. This vehicle can carry at least one large bag or suitcase (up to 23 kg per Participant), passengers, and equipment required for the tour.
Passenger and pillion riders are welcome on most tours. Pillion riders may switch between the motorcycle and the support vehicle as desired. Priority will be given to the support vehicle to injured or ill participants.
For private tours with fewer than five confirmed riders, a support vehicle may be added for an additional fee per Participant.
7. LUGGAGE
K.T.M. assumes no liability for loss, damage, or delay in the delivery of luggage during the tour. Due to variable weather and road conditions, the support vehicle may experience delays. Luggage transported by K.T.M. is done so at the Participant’s own risk. We recommend obtaining luggage insurance. Participants may also need to clear customs with their own luggage at border crossings.
8. WEATHER CONDITIONS
Weather conditions vary significantly by destination and season. While K.T.M. endeavors to schedule tours during favorable weather periods, we cannot be held liable for adverse weather conditions that occur during the tour. No refunds or adjustments to the tour price will be made due to unsuitable weather.
9. CHANGES TO SCHEDULE AND ITINERARY
K.T.M. aims to deliver tours as described on our website; however, the itinerary may be subject to change without prior notice due to weather, road conditions, or other factors that may affect the safety of the group or the quality of the tour experience. Changes may include alterations to the schedule or accommodation arrangements. No refunds or adjustments to the tour price will be provided for changes made under these circumstances.
10. CHANGE TO TOUR COST
The tour costs quoted are based on the rates in effect at the time of quotation. K.T.M. reserves the right to adjust the tour price in response to changes in cost factors such as currency fluctuations, insurance premiums, accommodation costs, or motorcycle rental fees. Any price adjustments may be made up to 60 days before the scheduled departure. Should the adjusted price be unacceptable to the Participant, they may cancel the reservation, and the entire deposit will be promptly refunded.
11. HEALTH AND BEHAVIOUR
Participating in extended motorcycle tours in challenging environments requires participants to be in good physical and mental health. K.T.M. requires that each Participant is fit to ride a motorcycle and complete the Medical Questionnaire with accurate information regarding health conditions, medications, and dietary needs. This ensures our tour leaders can accommodate any special requirements.
K.T.M. reserves the right to terminate a Participant’s involvement in the tour if they become disruptive or pose a risk to themselves or others. No refunds or credits will be issued for any termination of participation under these circumstances.
12. INSURANCE
K.T.M. strongly recommends that Participants secure comprehensive travel, health, and accident insurance, including trip cancellation and interruption insurance. Additionally, an Emergency Evacuation Membership is highly recommended and available through Global Rescue.
13. CANCELLATION AND RESCHEDULING
Deposit and balance payments are non-refundable. Under certain circumstances, funds may be transferable to a rescheduled date.

Reschedule requests made with more than 60 days’ notice are eligible for transfer to a new booking, subject to a $150 USD rescheduling fee. The remaining funds will be credited towards the new booking.
Reschedule requests made with less than 60 days’ notice will result in forfeiture of the deposit and balance payments as a cancellation fee. No credits or refunds will be issued.
Cancellations during or cutting short a tour will not entitle the Participant to any refunds or credits.
Credits are applicable only towards the balance of a tour and cannot be used as a new deposit. Credits expire one year from the date of issuance.
In exceptional circumstances, K.T.M. may need to advance or postpone a scheduled tour or travel arrangements. K.T.M. is not responsible for any resultant losses, expenses, or inconveniences, including but not limited to airline tickets, hotel reservations, activities, or automobile rentals.
No exceptions to this policy will be made for any reason. K.T.M. is not responsible for a Participant’s inability to attend a tour due to personal circumstances such as health, family matters, or environmental factors.
Trip cancellation or interruption insurance is strongly recommended to protect against potential losses related to deposits, balance payments, and other travel plans.
14. PHOTO AND VIDEO MATERIAL
Photos and videos captured by K.T.M. or its representatives during the tour are the property of K.T.M., and K.T.M. K.T.M. retains all copyrights and reserves the right to use this material for promotional and advertising purposes, including images in which individual Participants may be identifiable. Participants agree that no additional compensation will be provided for the use of such material.
15. ACCEPTANCE
By accepting these terms and conditions, I acknowledge that I have read and understood them. I am aware of the risks associated with motorcycle riding, including those arising from traffic conditions, road quality, weather, and the actions of other riders. I accept these risks and agree that K.T.M. is not responsible for my safety. I understand and agree that K.T.M., its affiliates, employees, agents, or representatives cannot be held liable for any injury, death, or damage to myself, my property, or my family, heirs, or assigns arising from my participation in any tour or rental provided by K.T.M.
16. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the internal laws of Colombia, excluding its choice of law provisions. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be exclusively brought in the District Court of Antioquia, Medellin, Colombia. The prevailing party in such proceedings shall be entitled to recover reasonable attorney’s fees and costs from the non-prevailing party.
